  1. Luke i apologise you have raised some excellent points here and your references to text are very good. Its true there is little in the way of case law in regards to this however the system can only be tried and tested in the future to a greater extent with more and more people able to copy these designs and DELIBERATELY market them knowing full well they are fake. Thanks Sorry just wanted to add, but with the internet becoming more accesible by the day and the information on it so easy to find surely the amount of instances this type of behavior were to arise would increase? lets be honest in the broad spectrum how many of us here have recieved emails asking for our account deatils to personal bank accounts? i know this is off topic but I think the ease with which people can obtain this informaiton definately dosent help. how do you prevent it? well to be honest I have no idea. I certainaly didnt intend for this to happen however speaking from experience I have to say its a very grey area in the world of law. i do however think that luke hit the nail on the head yes you would recieve a letter but its as the saying goes... you cannot sue a man of straw.
  2. whatever luke tell you what bring an action against me and lets see who wins ok. Were talking about a guitar here which at no time actually stated it WAS an original Washburn. The reason i put that on there was to attract buyers I agree and again I agree in hindsight the description may be misleading which is why it was A modified to state it was not an original washburn and then pulled by myself . good luck. by the way were talking real world here not law world and if you have any knowledge of the legal system you will know the difference between the two. There is a big gap there which I do ( my apologies for again rebuffung you ) tackle on a day to day business. Think about it, if I seriously thought I would jepardise number one my ebay rating which has been accumilated over 2 years or number 2 my reputation in the community and possibly lose my profession what do you think would be more important?? Now get a life go back to college and learn your facts properly. PLEASE. You did frankly annoy me with your original post which is why I'm now talking to you with all guns blazing. you wanna play then fine play away. just dont blame me when you get burned. I'm innocent in this apart from the fact that I was nieve if you cant get over that then thats your problem. Oh and by the way you want to preach about the law??? Talk to me I'm a commercial business lawyer who has been practising for 15 years now. So please throw me your questions and i'll answer them. I did the wrong thing and rectified it so look mate you wanna be the big I AM without any nuts go ahead and continue cos people like you who try to stoke the fires only makes things worse. Try READING the comments I have posted and then using an OBJECTIVE MIND come back to me. firstly prove intent. " Intent is classifiend as deliberately misleeding with knowledge of intent to mislead the consumer into a fraudulent transaction. If however the person subsequently discovers his or her actions to be misleading he or she is required to remove any offending material at such time immidiately ". and your next extremely clever and informed argument is?
  4. Ok so basically your telling me that you have never unintentionally in your life done anything wrong? Your saying that I'm a criminal for being nieve ( spelling ) in my actions? I find that hard to believe unless your just perfect and dont make mistakes. At least give a guy the credit for doing the right thing once he is informed that he is going about things the wrong way. have I not now retracted the auction? If I had any serious intention of being Dishonest would I have done that? If there is a lot of this going on then why not have a go at those people whom are seriously involved in fraudulent deals. That I agree with. However dont crucify the one guy who did try and do the right thing and try looking at all the facts next time. As soon as I knew there was a problem I pulled the ad. As soon as you guys started my alarm bells went off and I sorted it out IMMIDIATELY, so give me a break ok. Not everyone out there is a criminal. If you DO have a lot of people on here as you say that are eager to break the laws go talk to them about it. Do I have any markings on the guitar to say its a washburn? NO. Do I have serial numbers? NO. Is there people on THIS FORUM WHO DO?????? YES! Rhodes I apologise for being annoyed. I didnt honestly know this type of thing goes on and if I were in your shoes I would have been as pissed as you were. No hard feelings and good on ya.

Westhemann I do see your point, however you will have to excuse my idiocy as I can honestly say I had no idea that by listing this item as a real guitar ( which believe it or not was not my intention ) I would get more money for it. Dumb I know but honestly the situation. In hindsight I wont be listing it again as personally I dont want ANYONE to be able to say I'm a con artist or rip off merchant. I'm new to the hobby, new to listing this type of thing on ebay and yes people genuinely do make mistakes, I've been more than transparent here. However to be accused outright of this without the opportunity for me to rectify it ( if you check the thread you'll see what I mean ) well you may as well have just hung drawn and quatered me. Thank you for being reasonable and understanding this situation with your last post. But frankly I'm insulted and downright p*##ed off. Whatever did as you say happen to innocent before proven guilty. Maybe some people on this site need to start thinking rather than ganging up with there mates. Nepotism seems to be thriving well. Anyway thats me all done. Good luck with all your building efforts.
  6. Ok to finish this one off. I ended the auction because I have no intention of ripping anyone off. I did a search on ebay before listing and followed what SEVERAL other advertisers were saying in regards to homemade guitars. I accept that was a mistake and have heard the comments you have posted here have now retracted the item and will not be listing it again. The reason I'm annoyed is because number 1. None of you people know me, you dont know if I'm honest or not. However I take a lot of pride in the way I do business and as the listing stated ANYONE NOT HAPPY WITH IT UPON RECIEPT WILL RECIEVE A FULL REFUND. A FULL REFUND, FULL, COMPLETE, TOTAL. Plus which rather than anyone being polite on here and pointing this out to a complete beginner to this selling guitars on ebay you all start jumping on the bandwagon. When if someone had bothered to have to manners to politely say hey listen I think you should do this as these are the problems we have experienced in the past, I would have been happy to listen without question. I am Australian and Rhodes get off your high horse ok. Dont insult my nationalism or love for this country. I made a mistake and have now rectified it. I havent argued with your points because I'm mature enough to listen. But theres a way to dealing with people. Which obviusly reading some of the other threads in regards to this kind of topic on here you simply have no ability to handle. GuitarMaestro what am I five years old or something? I listened and removed it based on what was said as for getting my first negative rating do you think that with any of my auctions I'd seriously risk that? would you? No of course not. I'd deal with it before it ever got that far which is what I have done. But dont preach to me about thanking people for saving my rating when frankly the witchunt I've just experienced is the way you guys go about it. thanks

I tried to do everything you suggested but some of the muppets on here are still not happy so before giving the person a chance to change the listing again you decide to crucify him. Number 1 check my feedback its excellent 100% NEVER HAVE I EVER ATTEMPTED TO DEFRAUD ANYONE! NEVER BEFORE HAVE I SOLD A GUITAR LIKE THIS SO I'm VERY SORRY IF I DIDNT DO IT CORRECTLY BUT FRANKLY YOUR REACTION ALTHOUGH I CAN SEE THE POINTS IS AGGRESSIVE AND PATHETIC. THE AUCTION WILL BE SHUT DOWN BEFORE THE END OF TODAY AND AGAIN I WILL CANCEL ALL BIDS AS I DID WHEN IT WAS FIRST POINTED OUT TO ME!! Seriously dont fear you wont be seeing me here again.   9. Strange thing is on the back of the headstock its stamped JEM 555 and on the front it says Jem Jnr... go figure!
  10. Hi I've recently been offered a Jem Junior which is being advertised as a Jem 555. Is there a difference between the specs of the guitars or is it just a different branding for the same instrument? The seller does not know much about the history of the guitar and I cant find any diff between the two He wants approx $1200 AU for it. Any help would be really great. Thanks
